APS Trust for freelance contractors
What is an APS Trust?
APS Trust’s have been used throughout the last century as a vehicle for providing benefits to executives. The primary fiscal characteristics of the particular APS Trust we use is that it excludes the provision of “relevant” retirement benefits and that employees of the Company are excluded. This means that contributions made to the trust by the Company are not subject to income tax.
How do I join?
By simply filling in the documents in the pack we will provide. Once we have all of these signed and returned and they have been checked they are correct you can start to make contributions straight away.
When do I get paid?
Once the funds have been received into the Trustee Bank account it will be processed back to yourself within 24 hours, providing your bank operates the 'Faster Payments Service'.
Will I get a pay advice?
Yes, a pay advice will be issued for the PAYE element of your payment.
How will the completion of the tax return be done?
Our accountant will be assigned by you as your tax agent. We will provide them with all the necessary documents and details of your contributions for that tax year. Any other tax matters will be dealt with on an individual basis and the accountant will contact you directly.
If I leave the Trust part way through the tax year will you still assist me with the completion of my tax return?
The fee only covers you for the period you were in the Trust. If you leave and are paid via a different pay method we can still assist, however, there will be an additional hourly charge.
What checks do you do on me?
As this is a Trust we have to carry out Due Diligence and KYC (Know your Client) checks on all persons wishing to join. Our accountant will also carry out checks to make sure that all your tax affairs are up to date.
Where can I get investment advice?
If you contact us we will get one of our investment advisers to contact you and you will be dealt with on an individual basis.
Are there any hidden implications that I should be aware of from not paying income tax?
No, this structure has been operating within the law for the last 15 years. If any issue ever arose from any tax authority they would be dealt with by the Trustee and the Tax advisers solicitors
